By accessing or using WithGiga's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

WithGiga provides ASI (Artificial Superintelligence) for Computer Use Agents, including:

• Zero-shot automation with Computer Use Agents
• RPA 2.0 with advanced AI capabilities
• Workflow automation and process optimization
• Computer environment management and provisioning
• API access and integration services

To access certain features of our services, you may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information
• Notifying us immediately of any unauthorized use
• Ensuring your account information is kept up to date

You agree to use our services only for lawful purposes and in accordance with these terms. You agree not to:

• Use the services for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the services or servers
• Transmit viruses, malware, or other harmful code
• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Use the services to create competing products or services

Our services and their original content, features, and functionality are owned by WithGiga and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you create using our services, but you grant us a license to use, store, and process such content to provide our services to you.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference.

You are responsible for ensuring that any data you process through our services complies with applicable data protection laws and regulations.

We strive to provide reliable and continuous service, but we do not guarantee that our services will be available at all times. We may:

• Perform maintenance and updates that may temporarily affect service availability
• Modify or discontinue features or services with reasonable notice
• Suspend or terminate services for violations of these terms
• Experience outages due to circumstances beyond our control

To the maximum extent permitted by law, WithGiga shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to your use of our services.

Our total liability to you for any claims arising from these terms or your use of our services shall not exceed the amount you paid us in the twelve months preceding the claim.

You agree to indemnify and hold harmless WithGiga and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of our services
• Your violation of these terms
• Your violation of any third-party rights
• Any content you submit or transmit through our services

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these terms.

Upon termination, your right to use the services will cease immediately. All provisions of these terms which by their nature should survive termination shall survive termination.

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of our services shall be resolved in the courts of San Francisco, California.

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new terms on this page and updating the “Last Updated” date. Your continued use of our services after such changes constitutes acceptance of the updated terms.
